Age Discrimination
The California Fair Employment and Housing Act (“FEHA”) makes it unlawful for California employers to discriminate against an employee because they are 40 years of age or older.
To prove age discrimination under California law, an employee must show that their employer took an adverse employment action against them because of their age. Such actions may include refusing to promote an employee or terminating their employment because of their age. However, because direct evidence of an employer’s motivation for making an adverse employment decision is seldom available, our Los Angeles age discrimination attorneys often prove discrimination claims through circumstantial evidence.
Typically, an inference of age discrimination arises when it is shown that: (1) at the time of the adverse employment action, the employee was 40 years of age or older; (2) the adverse employment action was taken against the employee; (3) at the time of the adverse employment action the employee was satisfactorily performing their job, and (4) that the employee was replaced by a significantly younger worker.
Age-Based Harassment
In addition to discrimination, the FEHA prohibits harassment based on age. Age-based harassment occurs when an employer creates or allows an abusive, offensive, or intimidating work environment, which negatively impacts the employee’s ability to perform their job.
For example, age-based harassment often involves slurs, jokes, or derogatory remarks about a person’s age. These types of comments both support a claim for age discrimination and give rise to a separate claim for age harassment.
